Acceptance of Terms
By accessing or using Moments Forever services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Service
Moments Forever provides a digital memorial platform that allows users to create, customize, and share memorial pages for their loved ones. Our Soul Star product connects physical memorials to digital content through QR technology.
Account Registration
To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Content
You retain ownership of all content you upload to your memorial pages. By uploading content, you grant us a license to store, display, and distribute this content as necessary to provide our services. You are responsible for ensuring you have the rights to share any content you upload.
Prohibited Activities
You agree not to use our services to:
- Engage in any illegal activities or violate any laws
- Upload harmful, offensive, or inappropriate content
- Infringe on the intellectual property rights of others
- Distribute spam or malicious software
Payment Terms
Payment for subscriptions is processed through Stripe. By purchasing a subscription, you agree to pay all applicable fees. Prices are displayed in Euros and include applicable taxes where required. New customers receive a 14-day free trial: your subscription is not charged during the trial and renews automatically at the displayed price when the trial ends, unless you cancel beforehand. You can cancel at any time. One-time products (e.g. QR plates) are charged immediately and are not part of the trial.
Term, Renewal and Cancellation
A subscription runs for the term shown at purchase (usually one year) and then renews automatically for the same term at the price valid at that time, unless you cancel it by the last day of the term. We remind you by email 30 days before every renewal of the date, the price and how to cancel.
You can cancel at any time, without giving reasons, with effect from the end of the term:
- online via "Cancel contracts here" in the footer of every page of our platform and webshop, without logging in,
- in your account, or
- by email to [email protected].
We confirm receipt of your cancellation by email immediately, stating its content, the date and time of receipt and the date the contract ends. Until then you can take the cancellation back in your account.
Consumers whose habitual residence is in Germany may cancel the subscription at any time after the first term with one month's notice. We refund amounts already paid for the time after the contract ends on a pro rata basis.
The right to terminate for good cause remains unaffected. We may suspend your account or terminate the contract if you breach these terms.
After a Subscription Ends
When a subscription ends, for example after cancellation, withdrawal or non-payment, the memorial page stays visible to visitors for another 30 days but can no longer be edited. After that it is no longer available to visitors.
We keep your content for 12 months after the contract ends. During this time you can still log in and resume the subscription at any time; the memorial page is then fully available again. After the 12 months we permanently delete the memorial page and all its content. Memorial pages with lifetime access, for example via Soul Star plaques bought through partners, are not affected.
Right of Withdrawal (EU Consumers)
If you are a consumer, you may withdraw from a subscription contract within 14 days of its conclusion without giving any reason. To withdraw:
- online via "Withdraw from contract here" in the footer of every page of our platform and webshop, without logging in, or in your account,
- by a clear statement by email to [email protected] or by letter to Nolix Digital GmbH, {{ADDRESS}}, {{POSTAL_CODE}} Wien.
To meet the deadline it is sufficient to send your statement before the 14 days have expired. We confirm receipt by email immediately, stating its content, date and time.
Effects of withdrawal: The subscription ends immediately. We refund all payments made for the subscription without undue delay and at the latest within 14 days of receiving your withdrawal, using the same means of payment you used. You will not be charged any fees for this. During a free trial nothing has been charged yet; a withdrawal then simply ends the subscription.
Exclusion: QR plaques are made and personalised for a specific memorial page. They are therefore excluded from the right of withdrawal (Article 16(c) of Directive 2011/83/EU).

Limitation of Liability
Moments Forever is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for your subscription.
Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the new terms.
Governing Law
These Terms of Service are governed by the laws of Austria. Any disputes shall be resolved in the courts of Vienna, Austria.
